Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
Consumer: a natural person who is not acting for purposes related to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur.
Continuous performance contract: a distance contract relating to a series of products and/or services, where the obligation of supply and/or purchase is spread over time.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: a contract concluded between the entrepreneur and the consumer within an organized system for distance selling.
CESOP: the Central Electronic System of Payment Information as established by the European Union.

Article 3 – Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the contract is concluded, the text of these terms and conditions will be made available to the consumer electronically or in another durable format.


Article 4 – The Offer

All offers are non-binding. The entrepreneur reserves the right to modify or withdraw offers at any time.

The offer clearly states the total costs, including any shipping fees, import duties, taxes, and additional charges that may be imposed by postal or courier services.


Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and complies with the stated conditions.

The entrepreneur will confirm the conclusion of the agreement promptly via email.


Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 14 days from the day of receiving the product, without giving any reason.

The costs for returning the product are borne by the consumer.


Article 7 – Costs in Case of Withdrawal

The entrepreneur will reimburse all payments made by the consumer within 14 days after the withdrawal has been reported, provided that the product has been received back in its original condition and packaging.


Article 8 – Customs, Import Duties, and VAT Liability

8.1
All goods sold through this website are shipped under the Incoterm Delivered Duty Unpaid (DDU) as defined in Incoterms 2000. This means the customer is fully responsible for all costs and obligations related to importing goods into the destination country.

8.2
These obligations include, but are not limited to:

(a) payment of import duties, VAT or Goods and Services Tax (GST), and other applicable taxes;
(b) customs clearance costs, including administrative, inspection, and handling fees;
(c) compliance with local laws, regulations, and product requirements.

8.3
The entrepreneur does not act as the importer of record. Ownership and responsibility transfer to the customer upon shipment. The entrepreneur is not liable for delays, seizures, refusals, or penalties resulting from non-compliance with import regulations.

8.4
The entrepreneur provides necessary shipping documentation but does not guarantee compliance with all local requirements. The customer is responsible for verifying import restrictions.

8.5
The customer indemnifies the entrepreneur against any liability, claims, or costs arising from non-compliance with import regulations.

8.6
Customers are advised to contact local customs authorities in advance to avoid unexpected charges or delays.


Article 9 – CESOP Compliance

As of 2024, payment service providers are required to register certain transaction data in the CESOP system in accordance with EU regulations.

The entrepreneur complies with these obligations, which may affect the monitoring of payments.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement and with legal requirements at the time of delivery.

Any defects must be reported in writing within 14 days after discovery.

Products must be returned in their original condition and packaging, unless otherwise agreed.


Article 11 – Delivery

Orders will be delivered within 30 days, unless otherwise agreed.

In case of delays, the consumer will be informed within 14 days.

Orders are shipped with the customer responsible for import formalities.

The entrepreneur is not liable for delays caused by customs clearance.

Failure to comply with import obligations does not entitle the customer to cancellation or a refund.


Article 12 – Complaints Procedure

Complaints must be submitted clearly and in writing within 7 days after discovery.

The entrepreneur will respond within 14 days. If more time is needed, the consumer will receive a confirmation with an expected timeframe.


Article 13 – Disputes

These terms and conditions are governed by Dutch law.

Disputes will preferably be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.
